In recent years has been paid increased attention to the imposition of criminal sanctions on individuals in the Czech Republic, especially with a focus on alternative criminal sanctions for imprisonment. This extremely important area devotes attention to both practice and theory.

The article focuses on the traditional concept of criminal sanctions, defined on the basis of similar criteria as stated in the Czech Criminal Code, is missing within the European Union. This also fully applies to financial penalties.
How to adjust the European and Czech penalty to make it operational?

The way day-fines are fixed in the Czech Republic is unclear. In order to propose changes of the Czech system, all European countries using day-fines are compared and analysed. Three main areas are then particularly discussed: The fixing of the amount of one day fine, of the number of day fines and of the number of days of imprisonment in case of default. The article closes with discussion about different approaches which might change the current practise. A way which might be used by the Supreme prosecutor‘s Office is considered to be the most suitable one.

The article deals with possible reasons of a low number of pecuniary punishments in criminal proceedings imposing and puts forward legislative proposals of pecuniary punishment legislation, which could support the imposing of this criminal sanction in the future. The focus of the article is in the theoretical, statistical and partially in comparative analysis of assessing of a pecuniary punishment by daily rates, execution of pecuniary punishment and expungement legislation.
