Characteristics of criminal activity in the health service
JUDr. Jakub Chromý, Ph.D., MBA, státní zástupce Nejvyššího státního zastupitelství, email: jchromy@nsz.brn.justice.cz
In the submitted paper the author try to find answers to the question of what can be considered as a criminal activity in the health care sector and what circumstances can affect its content.
Penalty punishment – an untapped alternative?
Mgr. Vladimír Hackl, náměstek městského státního zástupce v Praze, Městské státní zastupitelství v Praze, email: vhackl@msz.pha.justice.cz
The author tried in his contribution to glimpse the potential, which the monetary punishment actually disposes according to the valid legal regulation. This potential, although it may be bigger, does not seem to be used. The parties to the imposition of monetary punishment are not about quantity, but especially about quality, which is determined mainly by its conquest.
Conversion of imprisonment to home prison sentence
JUDr. Roman Vicherek, soudce Okresního soudu v Ostravě a externí doktorand katedry trestního práva PrF MU, email: roman.vicherek@upol.cz
The paper deals with a relatively new institute of criminal law – the conversion of imprisonment into a prison sentence. The article deals with the circumstances of the establishment of this institute, its definition and, above all, with the application problems of judicial practice, which led to the fact that this institute is used by courts in a very minimal way.
Criminal relevance of the order – part I. (Concept of order)
JUDr. Jan Dvořák, pracovník státní správy
Although the notion of an order is not defined by the Criminal Code (and by any other law), it is relevant to criminal law in two different ways. For offenses, disobeying the order and disobeying the order of negligence bases the non-execution, or the refusal of the order.
A sworn oath according to German law
doc. JUDr. Filip Ščerba, Ph.D., katedra trestního práva PrF UP v Olomouci, email: filip.scerba@upol.cz
A swearing oath is an institute that is known in the Czech environment, rather than in historical or American films and serials. It can also be assumed that the composition of the oath prior to filing the testimony is usually understood as a procedural formality that is almost ceremonial.
Characteristics of criminal activity in the health service
