Better than perfect: About penalty and prison in fifty years

This article deals with the 50th anniversary of publication of Oto Novotný‘s book ‚Of punishment and prisons‘ [O trestu a vězeňství]. There are four main parts of the article: Reasons why the book is viewed as exceptional even after fifty years; certain criticism of ideological excesses and shortages due to the period when the book was published; general and specific ways how Oto Novotný can inspire us even after twenty years.

Inspection of opportunistic decisions of the public prosecutor

Submitted article deals with various possibilities of control of so-called opportunity decisions of public prosecutor who can discretionally decide on non-prosecution (event. termination) of criminal prosecution because of its inexpediency. Thus, with regard to prepared recodification of criminal procedural law, it reacts to proclaimed strengthening of opportunity exceptions from principle of legality and related demand on their increased control. While the article offers historical and comparative look back to analysed issue, its author presents her own attitude to contemporary as well as proposed control mechanisms. Object of de lege ferenda reflections is, in general, court control of opportunity decisions of public prosecutor, and then in particular, eventual implementation of private and subsidiary action into the Czech criminal proceedings.

The paper aims to point out the practical problems faced by the Public Prosecutor’s Office in connection with the recent finding of the Constitutional Court of the Czech Republic, which defined the Public Prosecutor’s Office as a party to the proceedings before the court and for the preparatory proceedings, where it then deduced from this position the requirement of a general determination of the local jurisdiction of the court to decide on the preparatory proceedings.

Criminal-law aspects of abortion in Poland

Criminal integrity of the botnetmaster in connection with providing botnet to a phishing attack

The botnet, a network of infected computers controlled by the originator of malware, is behind a high amount of threats to cybersecurity. It is logical that the legal science must react to this new security phenomenon, especially by deconstructing longtime criminal law institutes. This article deals with the criminal liability of botnet masters for the phishing attack committed by a third person with the help of a botnet.
