Trestní kolegium Nejvyššího soudu vydalo stanovisko ze dne 25. září 2014, sp. zn. Tpjn 303/2014, k jednotnému výkladu ustanovení § 314c odst. 1 písm. c) trestního řádu (dále jen „tr. ř.“) v otázce, zda skutečnost, že uplynula delší doba (v řádu měsíců) od počátku prověřování do sdělení podezření podezřelému podle § 179b odst. 3 trestního řádu, je důvodem pro odmítnutí návrhu na potrestání.

The procedure prosecutor after an opinion Criminal Division of the Supreme Court of the possibility of the court to reject proposal for punishment if the abbreviated preparatory proceedings precedens scan that lasted too long

The contribution deals with the theme of Summary Preliminary Hearing and impacts of the Opinion of the Supreme Court of the Czech Republic from 25th September 2014, sp. zn. Tpjn 303/2014, on Possibility of Judge dismiss of public prosecutor´s petition for punishment, if Summary Preliminary Hearing has came before reviewing the facts indicating that a criminal offence persisting for very long time, in relation with Public Prosecution´s activity. Such reviewing the facts indicating that a criminal offence of ten persists for some months or one year. Following Summary Preliminary Hearing is carried on legal deadline of two weeks. The deadline within which the summary preliminary hearing must be concluded, can be extended by a maximum of ten days, where agreement on guilt and punishment is being concluded,  by a maximum of thirty days. The focus of contribution is also related to possibilities of public prosecutor´s procedure after publication of mentioned opinion.
